These terms govern your use of the Gardero mobile app, website (gardero.app), and blog (collectively, the “Service”). By using the Service, you agree to these terms. If you do not agree, please do not use the Service.

Gardero is operated by Jiří Zoudun, based in the Czech Republic.

1. What Gardero Is

Gardero is a personalized garden care calendar that provides seasonal plant care recommendations based on your climate zone. It uses AI and editorial content to generate care schedules, plant identification, and gardening guidance.

2. Gardening Advice Disclaimer

This is the most important section — please read it carefully.

Gardero provides general gardening guidance for informational purposes only. It is not a substitute for professional horticultural, agricultural, or botanical advice.

We do not guarantee results. Plant care depends on many factors beyond our control — soil conditions, microclimate, weather events, pests, diseases, watering, and your individual care practices.
We are not liable for damaged, lost, or underperforming plants, crops, or gardens resulting from following recommendations provided by the app, blog, or any other part of the Service.
Always verify information. Our care schedules, blog articles, and any other content are generated or curated with care, but they may contain inaccuracies or may not apply to your specific situation. We strongly encourage you to cross-check recommendations with local gardening resources, nurseries, or agricultural extension services — especially for high-value plants or crops.
AI-generated content has limitations. Care recommendations and plant identifications produced by AI may be incorrect. Do not rely solely on AI identification for plants that could be toxic, allergenic, or otherwise hazardous.

3. Plant Identification

The plant identification feature uses a third-party AI service and is provided on a best-effort basis.

Identification results are suggestions, not certainties. Confidence scores are approximate.
Never eat, touch, or use a plant based solely on an AI identification. Some plants are toxic or cause allergic reactions. Always confirm with a reliable field guide or expert.
We are not responsible for any harm resulting from actions taken based on plant identification results.

4. Your Account

You must be at least 16 years old to use Gardero.
You must provide accurate information when creating an account.
You are responsible for keeping your login credentials secure.
You may delete your account at any time from the app settings. We will delete your data within 30 days (see our Privacy Policy).

5. Subscriptions and Payments

Gardero offers a free tier (up to 5 plants) and a paid Pro subscription.
Subscriptions are billed through the Apple App Store or Google Play Store. The store’s terms apply to all purchases.
Subscriptions auto-renew unless you cancel before the renewal date. You can manage or cancel your subscription through your device’s store settings.
We do not process payments directly — Apple or Google handles all billing.
Refunds are subject to the policies of the respective app store.
As an EU consumer, you have a 14-day right of withdrawal for digital purchases. By starting to use the Pro subscription immediately after purchase, you acknowledge that you may lose this withdrawal right once the service has been fully provided, in accordance with EU consumer law.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Attempt to reverse-engineer, decompile, or tamper with the app.
Scrape, crawl, or extract data from the Service in bulk.
Upload content that is offensive, harmful, or infringes on others’ rights.
Create multiple accounts to circumvent the free tier limits.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Your Content

When you add plants, photos, or notes to Gardero:

You own your content. We do not claim ownership of your photos, garden data, or any content you create.
You grant us a limited license to process your content solely to provide the Service (e.g., sending a photo to our plant identification provider).
You can export or delete your content at any time.

8. Intellectual Property

All Gardero content — including care schedules, blog articles, app design, and branding — is owned by or licensed to us. You may not reproduce, distribute, or create derivative works from our content without permission, except for personal, non-commercial use.

9. Availability and Changes

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access. Maintenance, updates, or technical issues may cause temporary downtime.
We may modify, add, or remove features at any time. If we make significant changes to these terms, we will notify you through the app or by email.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

Gardero is provided “as is” and “as available” without warranties of any kind, whether express or implied.
We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to crop loss, plant damage, or garden damage.
Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €50, whichever is greater.

Nothing in these terms limits liability that cannot be excluded under applicable law (e.g., liability for fraud or gross negligence).

11. Governing Law and Disputes

These terms are governed by the laws of the Czech Republic. Any disputes shall be resolved by the competent courts of the Czech Republic.

If you are a consumer in the EU, you retain any mandatory consumer protection rights under the laws of your country of residence. You may also use the EU Online Dispute Resolution platform.

12. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
